Fair use for instructional purposes prohibits copying without
permission if:
Copying is done to create, replace or substitute for anthologies, collective works, etc.
Copying substitutes for the purchase for books or periodicals.
Copying is repeated term to term by the same instructor.
Copying is of consumables, e.g., workbooks, standardized tests, etc.
Fair use of multiple copies for classroom use:
Can not exceed 1 per pupil per class
Must be made by or for the course instructor
Must include a notice of copyright on each copy
Must meet all the following provisions:
Brevity (Poetry)
A complete poem if less than 250 words and if printed on no more than 2 pages,
or, if a longer poem, an excerpt of no more than 250 words
Brevity (Prose)
A complete article, essay or story if less than 2,500 words. If the work is 2500
words or more, an excerpt of no more than 1000 words or
10% of the work, whichever is less.
Brevity (Illustration)
No more than 1 cartoon, chart, drawing, graph or picture per book or per periodical
issue.
Spontaneity
Copying may only be done at the instance and inspiration
of the individual instructor (not a higher authority)
and
The inspiration and decision to use the work and the
instance of its use are so close in time as to make it
impossible to obtain copyright permission.
Cumulative Effect
The copying is for only 1 class in the school.
Not more than 1 short poem, article, essay and not more
than 2 excerpts by a single author may be copied.
Not more than 3 excerpts from the same collective work
or periodical volume may be copied in 1 class term. (Newspapers
and current news periodicals are excluded).
No more than 9 instances of multiple copying for 1 course
during 1 semester are permitted. (Newspapers and current
news periodicals are excluded).
Video/DVD/Film
Legal possession of any of these formats does not confer
the right to show them. However, in the case of educational,
nonprofit educational institutions, these media may be used
if certain criteria are met:
Display is to a class.
The media is legal (not pirated) and a copyright notice is included.
Copying of videos/DVD/film
Copying of these media is strictly forbidden. The single
exception is a library that wishes to replace a work that
has been damaged or lost and cannot purchase it at a reasonable
price.
Off-Air Recordings of Broadcasts
Licenses may be obtained for copying. In the absence of a
formal agreement, copies may be made under the following guidelines:
Copied recordings may not be kept more than 45 calendar
days after the recording date. At that time recordings must
be erased or discarded.
Copies may be shown to students only within the first 10
school days of the 45 day retention period.
Off-air recordings may not be altered or combined with
others to form anthologies.
Obtaining copyright clearance
Order directly from the holder of the copyright.
Order from a commercial enterprise. The Copyright Clearance
Center is commonly used in higher education.
Placing materials on reserve in the Library will make
it unnecessary for you to do much of the work you now do and
you will be relieved of most of your copyright responsibilities.
